This website (store.plantsio.com) and the accompanying smart botanical platform are operated by PlantsIO ("we", "us", or "our"). PlantsIO offers this website, including all information, tools, AI-assisted hardware products (including the Ivy™ Smart Planter and future smart botanical devices), and companion software services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here. 

SECTION 1 - ONLINE STORE & ACCOUNT TERMS

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence. You may not use our products or software for any illegal or unauthorized purpose. To access full AI features and interactive functions, you may be required to register an account on the official PlantsIO mobile application. 

SECTION 2 - AI HARDWARE & SOFTWARE ECOSYSTEM

  • Smart Features: PlantsIO products combine physical botanical hardware with AI technology, sensory diagnostics, and wireless connectivity (Wi-Fi/Bluetooth). 
  • Network & OTA Updates: Certain AI insights and automated functions require stable internet connectivity. To maintain service quality and security, PlantsIO may deliver automated over-the-air (OTA) firmware and software updates to your connected devices.

SECTION 3 - FREE SHIPPING POLICY

  • Free Standard Shipping: We offer Free Standard Shipping on all hardware orders placed through store.plantsio.com, unless explicitly stated otherwise for promotional or specialized services.
  • Customs & Taxes: For international delivery, local import duties, customs taxes, or clearance fees imposed by destination countries remain the responsibility of the recipient.

SECTION 4 - LIMITED HARDWARE WARRANTY

PlantsIO provides a 1-Year Limited Warranty covering manufacturing defects in materials and electronic components for all official PlantsIO hardware products for one (1) year from the date of delivery.
Exclusions: This warranty does not cover damage caused by immersion beyond rated water resistance, physical misuse, unauthorized disassembly, or electrical power surges.

SECTION 5 - BOTANICAL CARE & AI DISCLAIMER

PlantsIO products utilize artificial intelligence and environmental monitoring to provide smart watering guidance, lighting feedback, and plant care insights. HOWEVER, PLANT VITALITY DEPENDS ON EXTERNAL FACTORS (E.G., PLANT SPECIES, SOIL RESILIENCE, WATER PROPERTIES, AMBIENT ENVIRONMENT, AND HUMAN CARE). PLANTSIO DOES NOT GUARANTEE THE SURVIVAL OR HEALTH OF ANY LIVE PLANTS OR CROPS AND IS NOT LIABLE FOR ANY FLORA LOSS.

SECTION 6 - INTELLECTUAL PROPERTY & PROPRIETARY AI

All intellectual property rights associated with PlantsIO products—including industrial hardware designs, AI algorithms, UI screen animations, trademarks, and app software code—belong exclusively to PlantsIO. Reverse engineering, decompiling device firmware, or extracting proprietary AI models is strictly prohibited.

SECTION 7 - LIMITATION OF LIABILITY

In no case shall PlantsIO, our directors, employees, or suppliers be liable for any indirect, incidental, or consequential damages (including loss of plant life or data transmission issues) arising from your use of or inability to use our AI devices or software.

SECTION 8 - GOVERNING LAW

These Terms of Service and any separate agreements shall be governed by and construed in accordance with the laws of the jurisdiction in which PlantsIO is legally registered.
